Terms of Service

The Fitzpo websites, related mobile applications, and services (collectively, the “Services”) are made available by Fitzpo, Inc. (“Fitzpo,” “we,” “us,” or “our”), with an address at 1019 S. Alvarado St. Los Angeles, CA 90006, USA, subject to these Terms of Service (the “Terms”) and in accordance with the Fitzpo Privacy Policy.

BY ACCESSING, USING, OR UPLOADING OR DOWNLOADING ANY INFORMATION OR MATERIALS TO OR FROM THE SERVICES, OR BY INDICATING YOUR ASSENT TO THESE TERMS BY CREATING AN ACCOUNT, CLICKING “SIGN UP”, REGISTERING, OR ANY SIMILAR MECHANISM, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICES.

SMS Terms & Conditions

Fitzpo may offer an SMS messaging program for client communication, including appointment coordination, reminders, scheduling updates, client support, account-related notifications, and other service-related communications, as well as occasional promotional messages regarding Fitzpo features, updates, and offers (the “Fitzpo Client Messaging Program”). By providing your mobile phone number and opting in to receive text messages, you agree to receive SMS messages from Fitzpo as described in this section and based on the consent options you select.

Consent to receive SMS messages is not a condition of purchase or use of Fitzpo services. You are responsible for providing a valid mobile number and for any message, data, or carrier charges that may apply. Supported carriers may vary, and message delivery is not guaranteed. Carriers are not liable for delayed or undelivered messages.

If you opt out by replying STOP, we may send you a one-time confirmation text confirming that you have been unsubscribed. After that, you will no longer receive SMS messages from that program unless you opt in again. If you need assistance, reply HELP or contact us using the support information listed above.

Registration and Accounts

The Services are intended only for persons who are at least 13 years old or such higher age required in your country to use the Services. If you are under the legal age to form a binding contract in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

To use the Services, you may be required to register and provide true, accurate, current, and complete information about yourself, and to keep that information updated.

Privacy

Our collection and use of personal information is governed by our Privacy Policy. If you choose to receive text messages from Fitzpo, the collection and use of your mobile number, consent records, and related messaging information is also governed by the SMS and mobile messaging provisions of our Privacy Policy.

Payments and Fees

Certain features of the Services may require payment of subscription fees or other charges. If you provide payment information, you authorize Fitzpo and certain third-party payment processors to receive, store, and process that payment information as needed to provide the Services.

Subscription fees may be billed monthly or annually, may auto-renew unless canceled, and may change upon reasonable advance notice. If you signed up through a third-party app store, billing and cancellation may also be subject to that store’s terms.

Content and Conduct

You own the content you submit to the Services, including information, data, text, images, videos, messages, and other materials, except as otherwise stated in these Terms. You grant Fitzpo a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, host, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and display your content as needed to operate, improve, and provide the Services.

You are solely responsible for the content you upload, post, transmit, or otherwise make available through the Services. You agree not to use the Services in a way that violates applicable law, infringes the rights of others, or breaches Fitzpo’s policies.

Third-Party Services

The Services may integrate with or link to third-party products and services, including third-party login providers, mapping providers, app stores, payment processors, devices, and communications providers. Your use of those third-party products and services may be subject to their own separate terms and privacy policies.

Communications

You agree that Fitzpo may send you administrative, transactional, service-related, and account-related communications by email, in-app messaging, push notification, or SMS, where permitted by law and in accordance with your preferences and consent. Electronic communications from Fitzpo satisfy any legal requirement that such communications be in writing.

Security

We use reasonable security measures designed to protect your account and information from unauthorized access. However, no method of transmission or storage is completely secure, and Fitzpo cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and notifying us promptly of any unauthorized use.

Termination

Fitzpo may suspend or terminate your access to the Services if you violate these Terms or if Fitzpo reasonably believes your use of the Services creates risk, harm, or legal exposure for Fitzpo or others. You may stop using the Services at any time and may cancel your subscription or delete your account in accordance with the options made available through the Services.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITZPO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Dispute Resolution

These Terms may include arbitration provisions and other limitations on how disputes are resolved, except where prohibited by applicable law. If a dispute arises, you agree to first contact Fitzpo to attempt to resolve the issue informally.

Changes to These Terms

Fitzpo may update these Terms from time to time. If we make material changes, we will post the updated Terms and revise the effective date above. Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the revised Terms.
